Terms of Service

These Terms of Service ("Terms") govern your use of CrewForged, a field service management platform operated by CrewForged ("CrewForged," "we," "us," or "our"). By creating an account or using the CrewForged platform, website, mobile applications, or related services (collectively, the "Service"), you agree to these Terms.

1. Eligibility and Account

To use CrewForged, you must:

  • Be at least 18 years of age
  • Have the authority to enter into these Terms on behalf of your business
  • Provide accurate and complete registration information
  • Maintain the security of your account credentials and two-factor authentication

You are responsible for all activity under your account and for all users you invite to your organization's account. CrewForged is designed for business use by trades companies and service businesses.

2. Subscription and Payment

2.1 Plans and Pricing

CrewForged is offered on a monthly subscription basis. Current plans are:

Pricing is flat per month — not per technician. AI features (Gemini AI) are included in all plans at no additional cost. Pricing is subject to change with 30 days' notice to existing subscribers.

2.2 Billing

  • Subscriptions are billed monthly via Stripe
  • Payment is due at the start of each billing period
  • Failed payments will be retried for 7 days before the account is suspended
  • There are no setup fees, implementation fees, or hidden charges

2.3 Cancellation

  • You may cancel your subscription at any time — no contracts, no penalties
  • Cancellation takes effect at the end of your current billing period
  • Your data remains accessible for 90 days after cancellation
  • After 90 days, data is permanently deleted unless you request earlier deletion

3. Your Data

3.1 Ownership

You own your data. CrewForged does not claim ownership of any business data you input into the platform, including customer records, job details, invoices, photos, forms, or any other content you create or upload.

3.2 License to Operate

You grant CrewForged a limited license to process, store, and display your data solely for the purpose of providing the Service. This license terminates when you delete your account.

3.3 Data Export

You may export your data at any time in standard formats (CSV, JSON). CrewForged will never hold your data hostage or make it difficult to leave.

3.4 Data Isolation

CrewForged is a multi-tenant platform. Your data is logically isolated from other customers using Row Level Security (RLS) at the database level. No customer can access another customer's data through any means.

4. Acceptable Use

You agree not to:

  • Use the Service for any unlawful purpose
  • Attempt to access another customer's data or account
  • Reverse engineer, decompile, or attempt to extract the source code of the Service
  • Use automated systems (bots, scrapers, crawlers) to access the Service without prior written consent
  • Transmit malware, viruses, or other harmful code
  • Use the Service to send unsolicited communications (spam)
  • Exceed reasonable usage limits designed to protect the platform's performance
  • Resell or sublicense access to the Service without authorization

5. AI Features

CrewForged includes AI-powered features (estimate suggestions, scheduling optimization, onboarding assistance) powered by Google Gemini. By using these features:

  • You understand that AI suggestions are generated automatically and should be reviewed before acting on them
  • AI-generated estimates, schedules, and recommendations are suggestions — you maintain full control and responsibility over final decisions
  • Your data processed by AI features is not used to train AI models
  • AI features may be updated or modified as the technology evolves

6. Third-Party Integrations

CrewForged integrates with third-party services including Stripe (payments), Google Maps (routing), Twilio (SMS), Resend (email), and optionally QuickBooks, payroll providers, and financing partners. Your use of these integrations is subject to their respective terms of service. CrewForged is not responsible for the availability, accuracy, or conduct of third-party services.

7. Customer Payments (Stripe)

When you collect payments from your customers through CrewForged:

  • Payments are processed by Stripe — CrewForged does not handle or store credit card information
  • Standard Stripe processing fees apply (currently 2.9% + $0.30 per transaction) and are paid by you or passed through to your customer, at your discretion
  • You are responsible for any chargebacks, disputes, or refunds related to your customer transactions
  • CrewForged facilitates the payment flow but is not a party to the transaction between you and your customer

8. Customer Financing

If you enable customer financing (Wisetack or similar providers):

  • The financing relationship is between your customer and the financing provider — CrewForged is not a lender
  • Merchant fees are deducted from your payout by the financing provider
  • Approval decisions are made by the financing provider, not CrewForged

9. SMS and Email Communications

When you send SMS or email notifications through CrewForged (appointment reminders, technician alerts, invoices, review requests):

  • You are responsible for ensuring your customers have consented to receive these communications
  • You must comply with applicable laws including the Telephone Consumer Protection Act (TCPA) and CAN-SPAM Act
  • CrewForged provides the tools — you are responsible for how they are used

10. GPS and Location Tracking

When GPS tracking is enabled for technicians:

  • You are responsible for informing your employees that their location is tracked during work hours
  • You must comply with applicable employment laws regarding employee monitoring
  • Tracking is limited to when the technician is clocked in and actively using the app
  • Account administrators can disable GPS tracking at any time

11. Service Availability

CrewForged strives for 99.9% uptime but does not guarantee uninterrupted service. We may perform maintenance with reasonable notice. In the event of an outage:

  • We will communicate status through our status page and email
  • Offline-capable features (technician mobile app) will continue to function locally
  • Data entered during an outage will sync when service is restored

12. Limitation of Liability

To the maximum extent permitted by law, CrewForged's total liability to you for any claims arising from or related to the Service shall not exceed the amount you paid for the Service in the 12 months preceding the claim. CrewForged is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost data, or business interruption.

13. Indemnification

You agree to indemnify and hold harmless CrewForged from any claims, damages, or expenses arising from: (a) your use of the Service, (b) your violation of these Terms, (c) your violation of any third-party rights, or (d) the actions of users you invite to your account.

14. Intellectual Property

The CrewForged name, logo, software, and documentation are the intellectual property of CrewForged. You may not use our trademarks without prior written permission. "Forged" and the Forged platform family (ProfitForged, ScribeForged, LedgerForged, CrewForged) are trademarks of their respective owners.

15. Termination

We may suspend or terminate your account if:

  • You violate these Terms
  • Your payment is past due for more than 14 days
  • Your use poses a security risk to the platform or other customers
  • Required by law

We will provide reasonable notice before termination unless immediate action is required for security reasons.

16. Dispute Resolution

These Terms are governed by the laws of the State of Florida. Any disputes will be resolved through binding arbitration in Pensacola, Florida, unless you and CrewForged agree to resolve the matter informally first. You waive any right to participate in a class action lawsuit against CrewForged.

17. Changes to These Terms

We may update these Terms from time to time. Material changes will be communicated via email and/or in-platform notification at least 30 days before they take effect. Continued use of the Service after changes constitutes acceptance of the updated Terms.
